| Divorce or dissolution of marriage is the ending of a marriage before the death of either spouse.In many developed countries, divorce rates increased markedly during the twentieth century.Among the states in which divorce has become commonplace are the United States, Canada, South Korea, and members of the European Union, with the exception of Malta (where all civil marriages are for life, because civil divorce is banned).Japan retains a markedly lower divorce rate, though it has increased in recent years.The subject of divorce as a social phenomenon is an important research topic in sociology.In some jurisdictions and countries, a divorce must be certified by a court of law, as a legal action is needed to dissolve the prior legal act of marriage.The terms of the divorce are also determined by the court, though they may take into account prenuptial agreements or postnuptial agreements, or simply ratify terms that the spouses have agreed on privately.Often, however, the spouses disagree about the terms of the divorce, which can lead to stressful (and expensive) litigation.Less adversarial approaches to divorce settlements have emerged in recent years, such as mediation and collaborative divorce, to negotiate mutually acceptable resolution to conflicts.In some other countries, like Portugal, when the spouses agree to divorce and to the terms of the divorce, it can be certified by a non judiciary administrative entity.Types of divorce

4 Who initiates divorce?This article or section deals primarily with the United States and does not represent a worldwide view of the subject.Australia since 1975 and the only thing the applicant needs to show is separation (or "deemed separation") for 12 months.The divorce application can be made by both parties jointly.Fault divorces used to be the only way to break a marriage, and people who had differences only had the option to separate (and were prevented from legally remarrying).In the United States, only the state of New York still requires fault for a divorce.However there are ways (defenses) to prevent a fault divorce:

Collusion
A defense is expensive, and not usually practical as eventually most divorces are granted, especially when the public is not interested in forcing people to remain married.Comparative rectitude is a doctrine used to determine which spouse is more at fault when both spouses are guilty of breaches.However, this typically does not change the state in which property and other issues are decided.Summary divorce
A summary (or simple) divorce, available in some jurisdictions, is used when spouses meet certain eligibility requirements, or can agree on key issues beforehand.When the parties can agree and present the court with a fair and equitable agreement, approval of the divorce is almost guaranteed.Collaborative divorce
Collaborative divorce is becoming a popular method for divorcing couples to come to agreement on divorce issues, in large part because of its high success rate.The parties are empowered to make their own decisions based on their own needs and interests, but with complete information and full professional support.Once the collaborative divorce starts, the lawyers are disqualified from representing the parties in a contested legal proceeding, should the collaborative law process end prematurely.Collaborative divorce can be substantially less expensive than litigation.Mediated divorce
Divorce mediation is an alternative to traditional divorce litigation.In a divorce mediation session, a mediator facilitates the discussion between the husband and wife by assisting with communication and providing information and suggestions to help resolve differences.At the end of the mediation process, the separating parties have typically developed a tailored divorce agreement that can be submitted to the court.Divorce mediation can be significantly less expensive than litigation.The lead characters in the film Wedding Crashers are divorce mediators.Divorce existed in antiquity, dating at least back to ancient Mesopotamia.The ancient Athenians liberally allowed divorce, but the person requesting divorce had to submit the request to a magistrate, and the magistrate could determine that the reasons given were insufficient.Although liberally granted in ancient Athens, divorce was rare in early Roman culture.Though civil authority rarely intervened in divorces, social and familial taboos guaranteed that divorce occurred only after serious circumspection.The Christian emperors Constantine and Theodosius restricted the grounds for divorce to grave cause, but this was relaxed by Justinian in the 6th century.By the 9th or 10th century of the Christian era, the frequency of divorce had been greatly curtailed by the influence of the Christian church.The husband and wife physically separated and were forbidden to live or cohabit together; but their marital relationship did not fully terminate.Because the marriage did not end, the husband had a continuing duty to support his wife (alimony).From the earliest years of the Christian age until the 18th century, annulment was the only means by which a marriage could be dissolved, and the circumstances under which annulment was proper was solely within the province of ecclesiastical courts.For in cases of total divorce, the marriage is declared null, as having been absolutely unlawful ab initio.Kent's Commentaries on American Law, p.Coke, Institutes of the Laws of England, 235 (Legal Classics Library spec.By marriage the husband and wife are one person in law: that is, the very being of legal existence of the woman is suspended during the marriage or at least incorporated and consolidated into that of the husband: under whose wing, protection and cover, she performs everything.Since husband and wife became one person upon marriage, that oneness could only be dissolved if the parties improperly entered into the marriage initially.Marriage later came to be considered a civil contract, and civil authorities gradually asserted their power to decree divorce.Divorce was granted only because one party to the marriage had violated a sacred vow to the "innocent spouse."Kent's Commentaries on American Law, p.Kent's Commentaries on American Law, p.Causes
A 2006 survey by DivorceMagazine.An annual study in the UK by management consultants Grant Thornton estimates the main causes of divorce based on surveys of matrimonial lawyers.The 2004 report concluded that campaigns like that of Fathers 4 Justice must succeed in increasing the percentage of shared residence orders, in order for more equitable financial divisions to become the norm.In their study titled "Child Custody Policies and Divorce Rates in the US," Kuhn and Guidubaldi find it reasonable to conclude that women anticipate advantages to being single, rather than remaining married.July, 2000 poll by DivorceMagazine.In their detailed analysis of divorce rates, Kuhn and Guidubaldi conclude that acceptance of joint physical custody may reduce divorce.States whose family law policies, statutes, or judicial practice encourage joint custody have shown a greater decline in their divorce rates than those that favor sole custody.Many religions have varied attitudes towards divorce, ranging from prohibited to acceptable behavior.There are significant emotional, financial, medical and psychological implications of divorce.There is an old joke which proceeds, "Do you know why divorce is so expensive?Different societies and legal jurisdictions have varying attitudes towards divorce.Look up Divorce in

the event of divorce is actually not
one event but three distinct processes.For convenience,
I talk of all three divorces in relation to the date when you separate,
the "S Date."Although
many divorces involve many "S Dates," I'm speaking here of the one that
really marks the end of the conjugal relationship.This drawing represents the three divorces
as occurring in time in relation to the S Date.For example, the Leaver's
Emotional Divorce typically begins and ends before the S Date, while both
the Social Divorce and the Left's Emotional Divorce begin and end after
the S Date.The legal divorce is
the part where lawyers and judges get involved.The legal divorce typically begins before the S Date
and ends anywhere from a few months later to a couple of years later.This
legal divorce is the one most people think of first when they conjure up
their image of divorce.It's also where most of us spend the most money
in divorce.In reality, though, the legal divorce is the easy part.The good news about
the social divorce is that, at least technically, it's not your job.Some of your friends
and family will handle the social divorce with dignity and acceptance.Others may cling madly to any hope they can find that the two of you will
reunite.Remember, though, the social divorce is not
your job.You've got enough to worry about.Let your friends and
family accept your divorce on their own schedule.Typically, the social
divorce doesn't really get underway until after the S
Date, and it may drag on for years.Why does the social divorce drag
on so long?The first is that you may have friends and family
(most particularly your children) who cling for years
to the hope that your divorce isn't really happening.The second reason
is that you probably have many friends, relatives, and acquaintances whom
you seldom see.They may not know for years that your divorce has happened.That means you'll have people coming up to you for years and asking you
how your spouse is.Please try your best to understanding of them.Tell
them gently and with as much neutrality as you can muster that the two
of you are divorced (or separated).This is by far the toughest
of the three divorces.This is where divorce gets messy.The tricky part about
the emotional divorce is that, unlike the legal
divorce and the social divorce, you and
your spouse deal with your emotional divorce on radically different schedules.Typically, the Leaver's
Emotional Divorce has been under way for months, often years.Your emotional divorce is more or less complete by the S
Date.This means that you've
probably given up on your marriage by the time you and your spouse separate.Incidentally, this is why I believe most trial
separations eventually result in divorce.The Left's Emotional
Divorce, on the other hand, typically doesn't begin in earnest until
well after the S Date, because even at separation,
the left often assumes there will be a reconciliation and that the marriage
will continue more or less as before.And once the left begins his or her
emotional divorce, the impatience of the leaver tends to compress it.Can you see what
happens?In many divorces, the emotional divorce of the left gets "squished."It's during the emotional
divorce of the left that spouses often behave
in bizarre ways.They want it to hurt, and they lash out any way they
can.Logic simply has no meaning to the left during
the peak of the emotional divorce.And because the left behaves in such
a bizarre way, or perhaps in anticipation that the left will behave in
a bizarre way, the leaver typically behaves in bizarre ways as well.It's
not a good combination.You're probably doing some
irresponsible and irrational things yourself.One question we should look into carefully, though, is what effect such a big change would have on the rate of divorce.To help us evaluate how important a question that is, I would also like to explore what t
he consequences of divorce are for children.First, what will happen to divorce rates?The honest answer is that no one knows.It seems that when most women have low incomes, few feel that they can afford to divorce.That
may increase the divorce rate.However, during the 1980's, when women's average earnings were rising considerably in the United States, divorce rates levelled off.Clearly, many other factors influence divorce rates.We can say that after the sexual division of labor melts away divorce will not be as harmful to women as it is today.They will not have as much trouble supporting themselves or their children, whether or not they
have custody, as the typical separated or divorced woman today.The myth is that a typical couple's divorce leaves their child seriously troubled, socially withdrawn or disruptive, with falling grades and disciplinary problems, and possibly in need
of psychotherapeutic counselling.Long ago, Francis Bacon saw wh
y: falsehood flies but truth comes limping after.Researchers interview 60 recently divorced couples who are experiencing such trouble with their separation that they have sought counselling from a professional psychologist.The researchers discover that after the divorce, many of the chil
dren in those families have trouble in school and struggle with intense feelings of anger and sorrow.The appendix of her first book, published nine years earlier, describes the unusual prevalence and severity of mental illness in her sam
ple.However, it tell us little about the children of a typical divorce.How could we figure out what the effect of divorce is on the typical children who experience it?We know that children of divorced parents have more emotional and behavioral problems and do less well in school than children who
live with both their biological parents.For one, parents with psychological problems are more likely to divorce and children of parents with such problems are more likely themselves to have a rough time.Se
cond, some parents who wind up divorcing have a long period of unpleasant conflict before they separate.Parental conflict causes many children to act up and do less well at school.Last, divorce itself may cause kids problems.The income and parental
time available to them drops, they see more conflict, the separation scares or angers them, and so on.When some marriages ended in divorce, we could look back and see which families were full of conflict all along, which kids acted up from an early age, and so.Such a study would be expensive and painstaking.Andrew Cherlin and his colleagues studied random samples of over 11,000 children in Great Britain and over 2,200 children in the U.They statistically controlled for the children's social class, race, the children's early behavioral and t
est scores, and factors such as physical, mental, and emotional handicaps as assessed by physicians.After controlling for those factors, boys of divorced parents scored as high as boys from intact couples on the behavioral and academic tests.For girls
, there was a small residual effect, apparently caused by the divorce itself, on their parents' and teachers' ratings of their behavioral problems.Their pain
is real and must be handled compassionately.However, by itself, the effect of divorce on children seems to be small.Politicians and lobbyists working to make it more difficult for Americans to divorce have either failed to learn about this research (p
ublished in one of the most famous scholarly magazines in the world) or they dishonestly ignore it.When the sexual division of labor in the home has melted away, what will divorce mean for children?Those improvements will also cushion the eff
